Effective this month, the possession of a firearm by an illegal alien is now a felony. Indiana Code 35-47-4 now states that an alien who is illegally or unlawfully present in the United States and knowingly or intentionally possesses a firearm commits unlawful possession of a firearm by an alien as a Level 6 felony.
Because immigration is regulated by the federal government, there is little doubt that if Indiana prosecutors desire to pursue and prove this requirement, it will require cooperation by the federal government. It is not difficult to envision local state prosecutors working with ICE officials or other federal law enforcement agencies to prosecute illegal or non-documented individuals whom they believe possess firearms.
