New Changes Coming to Indiana's Expungement Law!

As one of the biggest and most substantial new laws has begun to settle into use in Indiana courts, the Indiana General Assembly has made several revisions to Indiana Expungement Statutes. Some of the more substantial changes include:

  1. The burden of proof (the evidentiary threshold that must be met for a petition to be granted) has been reduced from Clear and Convincing Evidence to a Preponderance of the Evidence standard.
  2. An individual no longer needs to have successfully completed all terms of their sentence. Rather, the individual just needs to have paid all their fees, fines, court costs, and any imposed restitution amounts.
  3. A person seeking a petition no longer needs to have a valid driver's license.
  4. There is no longer a filing fee for filing an expungement petition.

The General Assembly has also made these changes effective immediately, if the Governor signs the bill. As such, expect these changes and more information very soon.
