Hoosiers Can Get Back on the Road

In 2014, the Indiana Legislature made an incredible leap in simplifying the manner in which a Hoosier whose license has been suspended can regain the privilege to drive. Prior to 2014, there were an incredible number of mandatory suspensions that existed based on any number of offenses under Indiana law. Once suspended, what was a Hoosier to do? The legislature has now created a single law to address that question, and erased the previously confusing laws that attempted to assist people in getting back their driving privileges.

Specialized Driving Privilege was born in 2014, and on May 5 th of this year, Governor Pence signed House Bill 1305 to clarify who is eligible for specialized driving privileges. This new law goes into effect on July 15, 2015. Many of the limitations on the previous law, such as a suspended driver having ever refused a chemical test during an OWI or DUI investigation, or having a valid CDL prior to the suspension, have been removed. The goal of the law is becoming clear, as the Cross Roads of America, it is time Hoosiers were allowed to drive again. The Specialized Privilege to drive after a suspension is left up to a judge who can review your driving history, listen to your concerns, and will make a determination on how, when, and where you can drive.
