Is a DUI a felony?

DUI has the potential to be a felony under a number of circumstances. The base DUI in the state of Indiana is a misdemeanor but it can be a felony charge if you have an individual under the age of 18 in your vehicle. It can also be a felony charge if you have a prior conviction for operating vehicle while intoxicated within the last five years.
