You May Still Have Options After Sentencing. Contact Our Firm to Discuss the Opportunity for Sentence Modification.

Sentence Modifications in Central Indiana

Did you know that you may be able to modify an existing sentence? After a completion of a criminal trial or certain guilty pleas, a sentence modification may be available to you to help adjust the jail or prison time you are required to serve or alter any aspect of your penalties. These modifications can be completed before or after you start your sentencing, and in some cases, our clients have been able to achieve a favorable reduction in their penalties.

To determine your eligibility to modify your existing sentence, do not hesitate to contact an Indianapolis criminal defense lawyer from Keffer Barnhart LLP right away.

There are a few things that will need to be determined prior to filing a petition for a modification. When you work with our firm, we can determine whether an error was made in the original sentencing process; if a reduction is available because of your age, mental ability or existing terminal illness; or if improper evidence was presented at your trial. These changes can be separate from a criminal appeal or can be filed in conjunction with a formal appeal to a higher court.

It is important that you act quickly though; in most situations, you have a limited amount of time following the close of a case to file a motion for a sentence modification.

The 2014 revisions to the Indiana Criminal Code have changed the penalties that you may be facing and the circumstances under which you can ask for a modification. Now, the Indiana Criminal Codes uses a numbered felony system with the new ranges listed below. If you were sentenced under the old Indiana Criminal Code, contact Keffer Barnhart LLP today!

Felony Level Sentencing Range
Level One Felony 20-40 years with an advisory sentence of 30 years
Level Two Felony 10-30 years with an advisory sentence of 17.5 years
Level Three Felony 3-16 years with an advisory sentence of 9 years
Level Four Felony 2-12 years with an advisory sentence of 6 years
Level Five Felony 1-6 years with an advisory sentence of 3 years
Level Six Felony 6 months-2.5 years with an advisory sentence of 1 year
